1. Identity of the Site operator

The website www.eyecatchers.team (the “Site”) is owned and operated by EYECATCHERS S.R.L., a Romanian legal entity with its registered office at 17 Camil Ressu Blvd, Bl. 57A, Entr. 1, 4th Floor, Ap. 19, Sector 3, Bucharest, Romania, registered with the Trade Registry Office attached to the Bucharest Tribunal under no. J2024022309008, Tax Identification Number (CUI) 50545918, with its main object of activity being CAEN 7311 – Advertising agency activities (“Eyecatchers”, “we”).

2. Definitions

• “User” – any person accessing the Site, whether or not they submit data through a form.

• “Applicant” – a person who submits an application through the /careers page.

• “Creator” – a person who submits an application through the /ugc-creators-ro page.

• “Materials” – any content uploaded or submitted by a User through the forms (CV, portfolio, links, video samples, etc.).

• “Services” – the advertising agency services provided by Eyecatchers, presented for information purposes on the Site.

3. Acceptance and modification of the Terms

By accessing and using the Site, you confirm that you have read, understood, and accept these Terms and Conditions, together with the Privacy Policy and the Cookie Policy, which form an integral part of the contractual framework governing use of the Site. If you do not agree with any of these provisions, please do not use the Site.

Eyecatchers may amend these Terms at any time for legitimate reasons (legislative changes, changes to the Site's features, or changes to our business practices). The applicable version is the one published on the Site at the time of access, identifiable by the “Last updated” date. Amendments do not apply retroactively.

4. Purpose and nature of the Site

The Site presents Eyecatchers' services and offers two application flows: (a) recruitment of employees and collaborators, through the /careers page; and (b) casting of UGC creators from Romania, through the /ugc-creators-ro page.

The information published on the Site is for informational purposes only and does not constitute a contractual offer within the meaning of the Romanian Civil Code. Submitting an application through the forms does not create any employment, collaboration, or other relationship, and does not oblige Eyecatchers to respond affirmatively, arrange interviews, or enter into any contract. Any contractual relationship is established exclusively through separate documents, negotiated and signed by the parties.

5. Rules for using the Site and the forms

By using the Site and submitting data through the forms, you undertake to:

• provide information that is true, accurate, complete, and current, and to update it if it changes materially during the selection process;

• submit only data that concerns you personally; you must not submit personal data of other individuals without a legal basis and without their consent;

• not include, in your CV, free-text messages, or Materials, any special category data under Art. 9 GDPR (health, ethnic origin, religious beliefs, sexual orientation, etc.);

• not submit content that is unlawful, defamatory, obscene, infringes third-party intellectual property rights, or contains viruses or malicious code;

• not use the Site for abusive automated purposes (scraping, spam, vulnerability testing) and not interfere with its operation.

Eyecatchers reserves the right not to process applications that breach these rules and to delete Materials submitted in breach of them.

6. Intellectual property

6.1. Site content. All elements of the Site — text, graphics, logos, visual identity elements, structure, design, and code — belong to Eyecatchers or its licensors and are protected by copyright and industrial property legislation. Reproduction, distribution, or use of these elements in any manner, without Eyecatchers' prior written consent, is prohibited, except for personal, non-commercial viewing.

6.2. User Materials. Materials you upload remain your property. By submitting them, you grant Eyecatchers a non-exclusive, royalty-free licence, limited to the purpose of: (a) evaluating your application; and (b) in the case of Creators, presenting your profile to Eyecatchers' clients for project-selection purposes, exclusively based on the consent expressed through the dedicated checkbox. The licence does not include the right to publish, commercially distribute, or modify the Materials; any such use is subject to a separate agreement.

6.3. Warranties. You represent and warrant that you hold the rights to the Materials submitted and that you have obtained the consent of any identifiable individuals appearing in them.

7. Limitation of liability

The Site is provided “as is” and “as available”. To the maximum extent permitted by applicable law, Eyecatchers is not liable for: (a) interruptions, technical errors, or temporary unavailability of the Site; (b) data loss caused by factors beyond its control; (c) decisions made by Users based on general information published on the Site; (d) the content of third-party sites accessible through links.

Nothing in these Terms excludes or limits Eyecatchers' liability in cases where the law prohibits such exclusion or limitation (for example, for damage caused intentionally or through gross negligence, or for breach of consumer rights recognised by mandatory legislation).

8. Third-party links

The Site may contain links to websites or services operated by third parties (for example, social media platforms). Eyecatchers does not control and is not responsible for their content, privacy policies, or practices. Accessing them is done at your own risk, and Users are advised to review the applicable policies of such third parties.

9. Force majeure

Neither party shall be liable for failure to perform its obligations caused by a force majeure event, as defined by the Romanian Civil Code, for the duration of such event.

10. Severability

If a provision of these Terms is declared null or unenforceable by a competent court, the remaining provisions shall remain fully valid, and the affected provision shall be replaced with a valid one that most closely reflects the original intent.

11. Governing law and dispute resolution

These Terms are governed by Romanian law. The parties will attempt to resolve any dispute amicably. Failing an amicable resolution, disputes shall be settled by the competent courts having jurisdiction over Eyecatchers' registered office (Bucharest), except where mandatory legislation (including consumer protection law) establishes a different jurisdiction.

Consumers may also use alternative dispute resolution (ADR) mechanisms and the European Online Dispute Resolution (ODR) platform, as provided by law.
